Apartop

Terms of use

Version 2.0 · 12 October 2026

On this page

These terms govern the use of Apartop (apartop.com), software for managing holiday rentals. By creating an account or using the service you accept them. This English version is a translation: the Spanish version prevails.

1. Who we are and who these terms apply to

Apartop is a service of GLENLAKE SOFT SL, tax ID B13872437, registered office at Calle Haya 9, Portal 1, 5.º A, 41927 Mairena del Aljarafe (Sevilla), España (“Apartop”). Contact: hola@apartop.com.

They apply to anyone who creates an account or uses the application to manage accommodation (hosts, owners, agencies and property managers, communities, complexes and receptions) and to the people they invite to their account (the “User”). Guests who only use online check-in and their stay guide have their own section (clause 15).

If you accept on behalf of a company or another person, you confirm that you can bind them. If you use Apartop for your business or professional activity, you are a “business” user; if you are an individual acting outside that activity, you are a “consumer” and the law gives you rights that these terms do not limit.

2. The service

Apartop helps you manage your accommodation: properties, calendars, bookings, guest check-in, guest registers, messages, cleaning, invoices, documents and more. We work to keep it running at all times, but we cannot guarantee that there will be no interruptions or errors, especially in what depends on third parties. We may improve, change or withdraw features; if we withdraw an essential feature of a paid plan we will give you reasonable notice.

3. Your account

  • You must provide accurate information and keep your Google account, or whatever you use to sign in, secure.
  • You are responsible for what is done from your account and for the users and permissions you give to your staff, owners and collaborators.
  • You must be of legal age and use Apartop for your rental or accommodation management activity.

4. Apartop is a tool: regulatory compliance is yours

4.1. Apartop is a software tool. You are solely responsible for complying with the rules that apply to your activity and your properties, before public authorities, platforms (Airbnb, Booking, VRBO and any other) and any third party, including:

  • guest registration and reporting to the police or other authorities (guest registers);
  • licences, tourist registrations, registration numbers and their display in listings;
  • limits on nights, guests or days per year, zoning, homeowners' associations and safety requirements for the property;
  • taxes, tourist taxes, withholdings and returns, and invoicing (including systems such as VeriFactu);
  • data protection for your guests, staff and owners, for which you are the controller (see clause 7);
  • contracts with guests, owners and collaborators, and consumer and rental rules.

4.2. The fact that Apartop offers a feature (for example, submitting a guest register, calculating a tax or reminding you of a date) does not mean it takes care of your obligation: review what you submit, keep and declare, and check that it has been done correctly.

5. Calculations, alerts, templates and guides: for guidance only

The calculations (tourist taxes, taxes, profitability, owner statements, suggested prices), alerts and reminders, templates (contracts, messages, privacy notices), guides, blog articles and information on each country's regulations offered by Apartop are for general guidance only. They are not legal, tax or accounting advice, may not be up to date or suited to your case, and do not replace consulting a professional or the competent authority. Check them against official sources before making decisions.

6. Platforms, integrations and third-party services

Apartop connects to third-party services it does not control (booking platforms and their calendars, Google, authorities' systems, smart locks, messaging services, AI assistants and others). Their availability, changes, errors and decisions (for example, blocking an account or listing, withholding payouts or rejecting a guest register) are the responsibility of those third parties. Apartop is not responsible for the information those services provide or for incorrect or incomplete data entered by you or your staff.

7. Your data and your guests' data

The data you upload is yours. You are the controller of your guests', staff's and owners' data, and Apartop processes it on your behalf as processor, only to provide the service. The data processing agreement forms part of these terms. You must have a legal basis to process that data and inform the people concerned. Apartop processes your account data as controller under the privacy policy.

8. Acceptable use

You may not use Apartop for illegal activities, for accommodation lacking the required licences or registrations where advertising or marketing it is prohibited, to send spam, to try to access other users' data, to copy or resell the service, or to harm it. We may remove content or suspend access that breaches this clause.

9. Price and payment

Paid plans are charged in advance through Stripe and renew automatically until you cancel them. You can cancel at any time from your account settings and keep access until the end of the paid period. Current prices are on the pricing page; if we change them we will notify you before the next renewal. If you are a consumer, you keep the rights consumer law gives you.

10. Closing and suspension

You can close your account at any time from Settings › Privacy and data. We may suspend or close accounts that breach these terms or the law, giving you notice beforehand except in serious or urgent cases. Before closing your account, download the data the law requires you to keep.

11. Limitation of liability

11.1. Apartop is not liable for:

  • penalties, fines, surcharges, claims, requests or inspections by public authorities arising from your activity or from failure to meet your obligations (clause 4);
  • claims by guests, owners, neighbours, communities, platforms or other third parties relating to your properties or your activity;
  • withheld payouts, penalties, cancellations, or blocking and suspension of accounts or listings decided by platforms such as Airbnb, Booking or VRBO;
  • errors in the data entered by you, your staff or your guests, or in third-party information (calendars, bookings, amounts, rules or data from authorities);
  • decisions you take based on calculations, alerts, templates or guides provided for guidance (clause 5);
  • indirect damages, loss of profit, loss of business, bookings or reputation.

11.2. In any event, Apartop's total liability to you for any cause related to the service is limited to the amount you paid to Apartop in the 12 months before the event giving rise to it.

11.3. These limitations do not apply in cases of wilful misconduct or gross negligence by Apartop, to personal injury, or to anything the law does not allow to be excluded or limited. If you are a consumer, they apply only to the extent permitted by consumer law.

12. Indemnity

If you are a business user, you will indemnify Apartop against claims, penalties and costs (including reasonable legal fees) brought by third parties, including public authorities, platforms, guests or owners, arising from your use of the service, your breach of these terms or the law, or the data and content you enter. Apartop will notify you of the claim as soon as it becomes aware of it, cooperate reasonably and not settle it without consulting you. If you are a consumer, you are liable for the damage you cause in accordance with the law.

13. Changes to these terms

These terms have a version number and date. If we change them we will publish the change here and, if it is significant, notify you by email and in the application with reasonable notice and ask you to accept them. If you do not agree, you can close your account; if you are a consumer, the change does not bind you until you accept it.

14. Governing law and courts

14.1. These terms are governed by Spanish law.

14.2. Business users (companies, self-employed people and anyone using Apartop for their business or professional activity): the parties expressly submit to the courts of Sevilla (Spain), waiving any other jurisdiction.

14.3. Consumers: the choice of Spanish law does not deprive you of the protection of the mandatory rules of the country where you habitually reside. You can sue Apartop in the courts of your domicile or of Apartop's domicile, and Apartop can only sue you in the courts of your domicile.

14.4. Before going to court, write to us at hola@apartop.com: we will try to resolve it amicably.

15. Guests

If you are a guest: your booking is with your host, not with Apartop; the accommodation, price, cancellation and payments are up to them. Online check-in and your stay guide are free for you and your link is personal: do not share it outside your group. Your data is processed by your host as controller and by Apartop on their behalf (see the privacy policy). For anything about your booking, talk to your host.
